Brand Terms of Service

These Brand Terms of Service govern the relationship between StreamerDap, brands, and media agencies using the StreamerDap platform to create and manage sponsorship campaigns.

By submitting a Purchase Order, launching a campaign, or otherwise using StreamerDap services, you agree to these Terms.

1. Purchase Order Allocation

Submitting a Purchase Order (“PO”) confirms your allocation of funds toward campaigns on StreamerDap.

These funds will be applied toward creator sponsorship placements based on the campaign parameters and selections configured within the platform.

2. Invoicing and Payment Terms

Invoices are issued upon Purchase Order submission.
If you are represented by a media agency, invoices may be sent directly to that agency.
All invoices are due within sixty (60) days of the invoice date (Net 60) unless otherwise specified.

Accepted payment methods may include:

  • credit card
  • ACH or bank transfer
  • PayPal
  • other payment methods listed on the invoice

3. Late Payments

Invoices not paid by the due date may incur a late fee of ten percent (10%) of the total invoiced amount.

Accounts with outstanding balances may be temporarily suspended from campaign creation or management until payment is resolved.

4. Invoice Disputes

Any invoice discrepancies must be reported to support@streamerdap.com within seven (7) days of the invoice date.

Disputes submitted after this period may not be eligible for review.

5. Campaign Budget Allocation

Campaign budgets are distributed to participating creators on a first-come, first-served basis unless otherwise specified.

Campaign spend continues until:

  • the campaign budget is exhausted
  • the campaign end date is reached
  • the campaign is terminated early

Final billed amounts may vary slightly from the planned campaign budget in order to ensure campaign spend does not exceed the limits you establish.

6. Creator Rates and Reporting Metrics

Creator compensation rates are based on each creator’s average concurrent viewership (CCV) over the previous 30 days on Twitch.

Once a campaign launches, these rates are fixed for the duration of the campaign.

Actual campaign performance metrics—including CCV, impressions, and engagement statistics—are reported through the StreamerDap campaign dashboard following each placement.

7. Sponsorship Deliverables

Campaign placements typically include:

  • sponsor logo display on the creator’s stream for up to fifteen (15) minutes per placement
  • promotional links appearing in chat every 1–3 minutes, depending on the creator’s configuration

StreamerDap tracks campaign engagement metrics including chat link clicks and placement performance.

If additional third-party tracking or attribution systems are required, those must be implemented by the brand or agency.

8. Creator Participation and Availability

Creator participation in campaigns is encouraged but not guaranteed.

StreamerDap facilitates campaign participation but does not guarantee that a specific creator will participate in a campaign.

Campaign reporting may include:

  • Video On Demand (VOD) links
  • performance analytics
  • delivery verification

Creators may voluntarily provide additional verbal or chat-based promotion, but such promotion is not required unless specified in campaign guidelines.

9. Content Violations and Brand Safety

Creators may be required to follow brand guidelines provided as part of a campaign.

If a creator fails to comply with campaign requirements—including hiding campaign assets or violating brand safety standards—you may report the issue through the campaign dashboard or by contacting support@streamerdap.com.

StreamerDap will investigate reported violations within three (3) business days.

If a violation is confirmed, affected campaign budget may be reallocated to other placements where appropriate.

Reports submitted more than fourteen (14) days after the stream date may not be eligible for review.

10. Refund Policy

Funds submitted through a Purchase Order are allocated toward campaign spend on the platform.

Unused Purchase Order balances are non-refundable unless otherwise agreed in writing.

11. Subscription Services

StreamerDap may offer subscription-based access to certain products or features (“Subscriptions”), including analytics tools, reporting dashboards, or platform access.

11.1 Subscription Term

Subscriptions begin on the start date defined in the applicable Ordering Document and continue for the specified term.

Unless otherwise stated, subscriptions automatically renew for successive renewal terms equal to the initial term (not exceeding one year) unless either party provides written notice of non-renewal at least 30 days prior to the renewal date.

11.2 Fees and Billing

Subscription fees are invoiced in accordance with Section 2 (Invoicing and Payment Terms).

Failure to pay Subscription fees when due may result in suspension or downgrade of subscription features.

11.3 Subscription Changes

Subscription upgrades, add-ons, or other changes may be requested through an updated Ordering Document.

Usage exceeding subscription limits may incur additional fees at StreamerDap’s then-current rates.

11.4 No Early Termination Refunds

Subscription fees are non-cancellable and non-refundable, including if you choose to stop using the Subscription prior to the end of the term.

12. ICA Managed Services

StreamerDap may provide campaign planning, setup, optimization, or reporting services (“ICA Managed Services”) where requested.

12.1 Scope of Services

The scope of ICA Managed Services will be defined in the applicable Ordering Document or Statement of Work (SOW).

12.2 Fees

ICA Managed Services fees may be structured as:

  • flat fees
  • percentage-of-spend fees
  • project-based fees
  • other fee models defined in the applicable agreement

These fees are separate from campaign media spend.

12.3 Client Responsibilities

You are responsible for:

  • providing brand guidelines and campaign parameters
  • supplying creative assets
  • obtaining internal approvals and compliance review
  • responding to StreamerDap requests for information

StreamerDap is not responsible for delays or performance impacts caused by missing or delayed client inputs.

12.4 Performance and KPIs

Campaign forecasts, projections, or KPI estimates are good-faith projections only and do not constitute guarantees of performance.

12.5 Cancellations

If you cancel or materially change a campaign after ICA Managed Services work has begun, you remain responsible for:

  • non-cancellable costs incurred
  • proportional fees for work already performed

13. AI Stream Monitoring and Analytics

StreamerDap may use automated technologies including machine learning and artificial intelligence (“AI Tools”) to monitor campaign performance and generate analytics.

13.1 AI Monitoring

AI Tools may analyze:

  • live streams and VOD content containing campaign assets
  • chat activity
  • campaign engagement data
  • related metadata such as timestamps, viewer counts, and performance metrics

13.2 Purposes

AI Tools may be used to:

  • measure campaign delivery and performance
  • detect potential content violations or brand safety issues
  • identify suspected invalid or fraudulent activity
  • generate analytics and reporting
  • improve StreamerDap products and services

13.3 AI Outputs

StreamerDap may provide certain AI-generated reports, alerts, scores, or insights (“AI Outputs”) through dashboards or reports.

AI Outputs may be used solely for internal business purposes related to campaigns conducted through StreamerDap.

AI Outputs may not be resold, sublicensed, or distributed as a standalone product without StreamerDap’s written permission.

13.4 Accuracy and Limitations

AI Outputs are probabilistic and may be incomplete or inaccurate.

They are intended to support, not replace, human review and decision-making.

13.5 Data Use and Privacy

StreamerDap may use data generated through AI Tools to operate and improve its services.

Any personal data is processed in accordance with the StreamerDap Privacy Policy and any applicable data protection agreements.

13.6 Compliance Obligations

You remain responsible for ensuring that your use of campaign analytics, AI Outputs, or audience targeting complies with applicable advertising, privacy, and consumer protection laws.

14. Limitation of Liability

StreamerDap provides its services “as is” without warranties of any kind.

To the fullest extent permitted by law, StreamerDap shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use of the platform or campaign services.

Brand Terms of Service

The Purchase Order Terms and Conditions define the agreements between StreamerDap, participating brands, and media agencies engaging in sponsorship campaigns. By submitting a purchase order and building campaigns on StreamerDap, you acknowledge and agree to the terms outlined below.

  1. Purchase Order Allocation: Submitting a Purchase Order (PO)confirms your allocation of funds toward future campaigns on StreamerDap. These funds will be applied to streamer sponsorships based on your campaign selections.
  1. Invoicing & Payment Terms: Invoices are issued upon PO submission. If you are represented by an agency, the invoice will be sent to your agency directly. All invoices are due within sixty (60) days of the invoice date (Net 60), and may be paid via accepted methods, including credit card, ACH/bank transfer, PayPal direct, or other options listed on the invoice.
  2. Late Payments: Unpaid invoices past the due date are subject to a late fee of ten percent (10%) of the total invoiced amount. Accounts with outstanding balances may be temporarily suspended until payment is resolved.
  3. Invoice Disputes: Any invoice discrepancies must be submitted to support@streamerdap.com within seven (7) days of the invoice date. Disputes received after this period may not be eligible for review.
  4. Campaign Budget Allocation: Budgets for each Campaign or Flight are distributed to streamers on a first-come, first-served basis until the campaign budget is fulfilled or the campaign end date is reached. Final billed amounts may vary slightly from the budgeted amount to ensure spend does not exceed the limit set by you.
  5. Streamer Rates & KPIs: Streamer rates are based on each streamer’s average concurrent viewership (CCV) over the past 30 days on Twitch. Once a campaign launches, these rates are fixed. Actual CCV and performance metrics are reported after each stream within the campaign dashboard.
  6. Sponsorship Deliverables: Sponsorship logos are displayed for up to fifteen (15) minutes per placement. Promotional links appear in chat every 1–3 minutes, depending on the streamer’s chosen setting. StreamerDap tracks the number of chat link clicks; however, third-party tracking must be handled by the client.
  7. Streamer Participation & Availability: While streamer participation is encouraged, it is not guaranteed. Participating streamers will have Video On Demand (VOD) links and detailed reporting available post-stream as proof of delivery. Streamers may voluntarily provide verbal or chat promotion, but it is not required.
  8. Content Violations & Brand Safety: Streamers must adhere to your brand guidelines if provided. If a logo is hidden or reduced to less than 5% of the visible stream area, or if a streamer violates brand requirements or attempts to sabotage a campaign, please report the issue through the campaign report dashboard or via email. We will investigate within three (3) business days. Confirmed violations will result in budget reallocation. Reports submitted more than fourteen (14) days after the stream date may not be eligible for review.
  9. Refund Policy: All funds submitted via PO will be allocated to campaigns. Unused PO balances are non-refundable.
  10. Subscriptions:

    11.1 Subscription Services: In addition to campaign-based spend, you may purchase subscription-based access to certain StreamerDap products or features (“Subscriptions”), such as platform access, analytics, or reporting tools. The specific Subscription tier, features, limits, fees, and term will be set forth in the applicable purchase order, insertion order, or other written ordering document that references these Brand Terms of Service (each, an “Ordering Document”).

    11.2 Term and Renewal: Unless otherwise stated in the applicable Ordering Document, each Subscription will commence on the Subscription start date specified therein and continue for the initial Subscription term indicated. At the end of the initial term, the Subscription will automatically renew for successive renewal terms equal to the initial term (but no longer than one (1) year at a time), at StreamerDap’s then-current Subscription rates, unless either party provides written notice of non-renewal at least thirty (30) days before the end of the then-current term.


    11.3 Fees, Invoicing, and Non-Payment: Subscription fees will be invoiced and payable in accordance with Section 2 (Invoicing & Payment Terms). Failure to pay Subscription fees when due may result in temporary suspension or downgrade of Subscription features, in addition to any late fees or remedies described in Section 3 (Late Payments).

    11.4 Changes and Overages: You may request Subscription upgrades, add-ons, or other changes via an updated Ordering Document. Any usage that exceeds the limits of your Subscription (such as additional campaigns, seats, or data access beyond the included allowance) may be subject to additional fees at StreamerDap’s then-current rates or as otherwise agreed in an Ordering Document.

    11.5 No Early Termination Refunds: Except as expressly stated in an Ordering Document or required by applicable law, Subscription fees are non-cancellable and non-refundable, including if you choose to stop using the Subscription or terminate for convenience before the end of the then-current term.

  11. ICA Managed Services

    12.1 Description of Services: From time to time, you may elect to engage StreamerDap to provide hands-on campaign strategy, planning, setup, optimization, and/or reporting services in connection with campaigns (“ICA Managed Services”). The scope of any ICA Managed Services (including deliverables, timelines, and responsibilities) will be described in the applicable Ordering Document or statement of work (“SOW”).

    12.2 Fees and Billing: Fees for ICA Managed Services may be structured as flat fees, percentage-of-spend fees, project-based fees, or other models as specified in the applicable Ordering Document or SOW. Unless otherwise stated, ICA Managed Services fees are in addition to any media, campaign, or PO spend and will be invoiced in accordance with Section 2 (Invoicing & Payment Terms).

    12.3 Your Responsibilities: You remain responsible for (i) providing complete and accurate brand guidelines, targeting parameters, and creative assets; (ii) obtaining any necessary internal approvals and legal or compliance review; and (iii) responding to StreamerDap’s requests for information in a timely manner. StreamerDap will not be liable for delays, under-delivery, or performance shortfalls to the extent caused by your failure to provide required information, approvals, or assets.

    12.4 Performance and KPIs: Any key performance indicators (“KPIs”), forecasts, or performance estimates referenced in an Ordering Document, SOW, or other materials are good-faith projections only and do not constitute guarantees. While StreamerDap will use commercially reasonable efforts to execute ICA Managed Services in accordance with agreed strategies and industry practices, StreamerDap does not warrant or guarantee any particular level of impressions, clicks, conversions, revenue, or return on ad spend.

    12.5 Cancellations and Changes: If you cancel or materially change a campaign or SOW after StreamerDap has begun ICA Managed Services, you will remain responsible for any non-cancellable costs already incurred and for the proportionate fees for work performed up to the effective date of cancellation or change, unless otherwise agreed in writing.

  12. AI Stream Monitoring

    13.1 Use of AI Tools: You acknowledge and agree that StreamerDap may use automated technologies, including machine learning and artificial intelligence (“AI Tools”), to capture, monitor, and analyze streams, VODs, chat activity, and related engagement data associated with campaigns run through StreamerDap.

    13.2 Purposes: AI Tools may be used to:

    • Measure campaign delivery and performance (including duration and viewability of logos, integration of Sponsored Assets, chat link frequency, and click activity);
    • Help identify potential content violations or brand-safety issues;
    • Assist in detecting suspected invalid or fraudulent activity; and
    • Generate analytics, reporting, and insights and support improvement of StreamerDap’s products and services.

    13.3 AI Outputs and Access: Subject to your payment of applicable fees and compliance with these Terms, StreamerDap may make available certain AI-generated reports, scores, alerts, or insights (“AI Outputs”) through dashboards, reports, or APIs. You may use AI Outputs solely for your internal business purposes in connection with campaigns run via StreamerDap and in accordance with these Terms. You may not resell, sublicense, or commercially exploit AI Outputs as a standalone product or service without StreamerDap’s prior written consent.

    13.4 Accuracy and Limitations: You understand that AI Tools and AI Outputs are probabilistic and may be incomplete, inaccurate, or biased. AI Outputs are provided “as is” and are intended to assist, not replace, human review and judgment. You remain solely responsible for decisions or actions you take in reliance on AI Outputs and for complying with all applicable laws and any public statements you make about your use of AI.

    13.5 Data Use and Privacy: StreamerDap may use data collected via AI Tools to provide, operate, maintain, and improve its services, including training and tuning models, provided that any personal data is processed in accordance with StreamerDap’s Privacy Policy and, where applicable, any separate data protection or data processing terms agreed between you and StreamerDap.

    13.6 Compliance Obligations: You are responsible for ensuring that your instructions to StreamerDap and your use of AI Outputs (including any audience or user profiling, targeting, or decision-making based on such outputs) comply with applicable advertising, privacy, and consumer-protection laws and self-regulatory standards, as well as your own published privacy notices and policies.
